Terms of Service

These Terms govern your access to and use of storefront.ng and any stores hosted on our platform in Nigeria.

1) Agreement to Terms

By accessing or using Storefront’s websites or hosted stores (the Services), you agree to be bound by these Terms. If you do not agree, do not use the Services.

Where laws differ across jurisdictions, these Terms apply to the extent permitted under Nigerian law.

2) Eligibility & Accounts

  • You must be at least 18 years old to create a merchant account.
  • You are responsible for the security of your account credentials and all activity under your account.
  • Provide accurate information and keep it up to date.

3) Merchant Terms

  • Compliance: You are responsible for your store and content, and for complying with all applicable Nigerian laws and regulations (including advertising, consumer protection, product safety, NDPA data protection requirements, and export controls where applicable).
  • Products: You may not sell illegal, counterfeit, or restricted items. This includes narcotics, weapons, unsafe food or drugs, and any goods prohibited by Nigerian law.
  • Orders & Fulfilment: You are responsible for accurately listing products, pricing, shipping, delivery, and handling returns in line with Nigerian consumer rights.
  • Customer Data: You are the controller of shopper data collected through your store. Use it only for lawful purposes and secure it appropriately.
  • Chargebacks & Disputes: You are responsible for chargebacks and customer disputes arising from your store’s transactions.

4) Shopper & Visitor Terms

When you purchase from a Storefront-hosted store, you are buying from the individual merchant, not from Storefront. Questions about orders, delivery, returns, or warranties should be directed to the merchant. Your statutory rights under Nigerian law remain unaffected.

5) Plans, Fees, Payments & Taxes

  • Subscription fees and other charges are displayed during sign-up or in your dashboard.
  • Payments are processed by independent payment processors such as Paystack and Flutterwave. Card details are handled by those providers, not by Storefront.
  • You are responsible for any applicable taxes, duties, or levies related to your use of the Services.

6) Trials, Cancellation & Refunds

  • You can cancel a subscription at any time in your dashboard; cancellation stops future billing.
  • Fees already paid are non-refundable except where required by Nigerian law.
  • Access to paid features continues until the end of the current billing period unless suspended for breach.

7) Acceptable Use & Prohibited Activities

You may not use the Services to:

  • Violate any Nigerian law or third‑party rights (including IP rights).
  • Sell illegal or restricted items (e.g., narcotics, weapons, counterfeit goods, stolen property, or items that require permits you do not have).
  • Engage in fraud, money laundering, terrorist financing, or other unlawful conduct.
  • Interfere with or disrupt the Services, including introducing malware or scraping without permission.
  • Collect personal data without consent or a lawful basis, or use it in ways that breach the NDPA.

8) Intellectual Property

The Services, including software, logos, and design elements, are owned by Storefront or its licensors and are protected by law. We grant you a limited, non‑exclusive, non‑transferable licence to use the Services for your lawful business purposes. You must not copy, modify, reverse‑engineer, or create derivative works from the Services except where permitted by law.

Merchants retain ownership of their store content. By using the Services, you grant Storefront the rights necessary to host, display, and operate your store and to provide the Services.

9) Integrations (Paystack, Flutterwave, WhatsApp, Meta)

  • Integrations are provided “as is” by the third‑party providers. Their terms and privacy policies apply.
  • For payments, Paystack and Flutterwave process card data directly; Storefront does not store full card details.
  • For messaging or social integrations (e.g., WhatsApp, Facebook/Meta), you must follow the provider’s policies. Data deletion instructions for Meta integrations are provided in our Privacy Policy.

10) Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect and use personal data in Nigeria and includes Meta data‑deletion instructions. The Privacy Policy forms part of these Terms.

11) Security

We implement administrative, technical, and organisational measures to safeguard the Services. However, no system is completely secure. You are responsible for securing your devices, networks, API keys, and account credentials.

12) Suspension & Termination

  • We may suspend or terminate access if you breach these Terms, the law, or pose security/operational risks.
  • You may terminate at any time via your dashboard. Termination does not affect obligations incurred before termination.
  • Upon termination, your right to access the Services ends, but clauses intended to survive will continue (e.g., IP, payments, disclaimers, liability limits, indemnity, governing law).

13) Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by Nigerian law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

14) Limitation of Liability

To the maximum extent permitted by Nigerian law, Storefront will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, goodwill, or data, arising from or related to your use of the Services. Our aggregate liability for any claims relating to the Services will not exceed the amounts paid by you to Storefront in the 3 months preceding the claim.

15) Indemnity

You agree to indemnify and hold harmless Storefront and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your breach of these Terms or applicable law.

16) Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of them are governed by the laws of the Federal Republic of Nigeria. You agree to the exclusive jurisdiction of the Nigerian courts. Nothing prevents either party from seeking urgent injunctive or equitable relief in a competent court.

17) Changes to the Service & Terms

We may modify the Services or these Terms to reflect operational, legal, or regulatory changes. We will post updates here and adjust the “Last updated” date. Continued use after changes take effect constitutes acceptance.
